A SENATE RESOLUTION

TO AMEND THE RULES OF THE SENATE BY ADDING A NEW RULE SO AS TO PROHIBIT INAPPROPRIATE POLITICAL ACTIVITY OF EMPLOYEES ELECTED BY THE SENATE, TO PROVIDE SANCTIONS FOR VIOLATIONS, AND APPLICABLY TO THOSE EMPLOYEES ELECTED BY THE SENATE.

Be it resolved by the Senate:

That the Rules of the Senate be amended by adding an appropriately numbered rule to read:

RULE ___.

Conduct of Senate Employees Elected by the Senate

A.

All employees elected by the Senate shall refrain from inappropriate political activity as defined in this rule. In addition to activity otherwise prohibited by statute, all Senate elected employees are prohibited from:

(1) acting as a leader or holding an office in a political organization;

(2) publicly endorsing or publicly opposing any candidate for the South Carolina Senate, the South Carolina House of Representatives, or a candidate for any statewide office;

(3) making speeches on behalf of a political organization;

(4) attending political gatherings or functions, whether or not there is a charge to attend; and

(5) soliciting funds for, paying an assessment to or making a contribution to a political organization or candidate, or purchasing tickets for a political party or organization dinner or any other function.

B.

Employees who violate the provisions of this rule are subjected to sanction by the Senate Operations and Management Committee. The Committee shall establish a procedure for the filing and disposition of complaints made pursuant to the provisions of this rule.

C.

The provisions of this rule shall apply to all employees elected by the Senate at all times, irrespective of employment status.
