Similar(H 2503) A Bill to amend Section 34-11-60, Code of Laws of South Carolina, 1976, relating to drawing and uttering fraudulent checks; so as to provide a process for the establishment of prima facie evidence of the identity of the person issuing a check, to further provide a process to create a duty upon the drawee of any check to state the reasons for dishonor in order to establish prima facie evidence of knowledge of insufficient funds, no bank account or incorrect or insufficient signature by the drawer of a check; to amend Section 34-11-70, relating to fraudulent intent in drawing and uttering checks, so as to provide a procedure for the notification of the drawer of a dishonored check, so as to establish prima facie evidence of fraudulent intent against the drawer, to further provide civil immunity for persons giving notice under the provisions of this Section, to further provide that costs accruing from the prosecution of persons under the provisions of Section 34-11-60 shall be paid by the party applying for the warrant when the case is dismissed for want of prosecution, to allow a court to dismiss any prosecution upon proof of restitution under certain circumstances, to further provide for mandatory restitution by persons convicted of an offense under Section 34-11-60 and to amend Section 34-11-90, relating to the jurisdiction of offenses and penalties, so as to increase the amount of penalties magistrates may impose for violations of Section 34-11-60. 01/18/79 House Introduced and read first time HJ-210 01/18/79 House Referred to Committee on Judiciary HJ-211 02/22/79 House Tabled in committee
