A BILL

TO AMEND CHAPTER 17, TITLE 25, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PreviousNATIONALNext GUARD MUSEUM AND STATE WEAPONS COLLECTION SO AS TO CHANGE ITS NAME TO THE SOUTH CAROLINA MILITARY MUSEUM, RENAME AND REVISE ITS GOVERNING BOARD, AND MAKE OTHER REQUIRED CONFORMING AMENDMENTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 17, Title 25 of the 1976 Code is amended to read:

"CHAPTER 17

PreviousNationalNext Guard Museum and State Weapons

Collection

South Carolina Military Museum

Section 25-17-10. There is hereby established the South Carolina PreviousNationalNext Guard Military Museum and State Weapons Collection, which shall be domiciled located at one or more PreviousNationalNext Guard locations in the State as selected by the State Adjutant General. The museum and weapons collection shall be is governed by a the South Carolina Military Museum Board of managers composed of five seven members. Two Five members shall must be appointed by the Adjutant General whose for terms shall be concurrent with that of the Adjutant General and one member shall be selected by The Field Artillery Society of The South Carolina Militia to serve such term as may be determined by the Society. The other two members, who shall serve ex officio, shall be The Adjutant General and the President of the South Carolina PreviousNationalNext Guard Association shall serve as members ex officio.

Section 25-17-20. The board shall hold regular meetings, prescribe rules for its operations, elect such the officers as are necessary, establish and use any identifying seal pertaining to museum business, and make an annual report which shall must be included as a part of the Adjutant General's report to the Governor. For the purpose of transacting business, three four members shall constitute a quorum. The members of the board shall serve without compensation.

Section 25-17-30. PreviousNationalNext Guard Military Department of South Carolina equipment, supplies, and personnel may be used to maintain the museum and weapons collection, but no state funds shall be expended therefor. The board may improve existing grounds by the construction of concrete slabs and fencing for suitable outdoor display of large items of heavy equipment such as artillery, armored vehicles, and other military equipment and weapons.

Section 25-17-40. The board may accept lands, buildings, money, relics, weapons, or any other thing of value on behalf of, or as additions to the museum either in the form of loans or grants or donations or bequests; may acquire land and items by purchase, lease, or otherwise and may enter into contracts with any person to accomplish such purposes. Any such gifts, donations, or bequests shall be deemed to be are considered gifts to a charitable or eleemosynary organization.

Section 25-17-50. The museum and weapons collection shall must be a military and historical museum charged with the responsibility for the collection, preservation, and exhibition of archives, books, records, documents, maps, charts, military equipment, uniforms, flags, and any other such articles. It shall may be a depository for collections of all weapons, especially weapons seized by the State, and any other materials deemed considered relevant to Previousnational, state, or local history by the board of managers. The museum and weapons collection shall must be open to the public at such times as may be determined by the board."

SECTION 2. This act takes effect upon approval by the Governor.
