TO AMEND SECTION 56-3-115, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DEPARTMENT OF MOTOR VEHICLES ISSUING PERMITS TO PreviousOWNERSNext OF GOLF CARTS THAT ALLOW THE GOLF CARTS TO BE OPERATED ON HIGHWAYS AND STREETS, SO AS TO PROVIDE THAT TO OBTAIN A PERMIT THE PreviousOWNERNext OF A GOLF CART SHALL PROVIDE THE DEPARTMENT PROOF OF ITS PreviousOWNERSHIPNext.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 56-3-115 of the 1976 Code, as last amended by Act 69 of 2003, is further amended to read:

"Section 56-3-115.    (A)    The PreviousownerNext of a vehicle commonly known as a golf cart, if he has a valid driver's license, may obtain a permit from the department upon the payment of a fee of five dollars and proof of financial responsibility which permits his agent, employees, or him to:

(1)    operate the golf cart on a secondary highway or street within two miles of his residence or place of business during daylight hours only; and

(2)    cross a primary highway or street while traveling along a secondary highway or street within two miles of his residence or place of business during daylight hours only.

(B)    The PreviousownerNext of a golf cart shall provide proof of its PreviousownershipNext in the form of a bill of sale, certificate of origin, or other evidence satisfactory to the department to prove his Previousownership of the golf cart."

SECTION    2.    This act takes effect upon approval by the Governor.
