A BILL

TO AMEND SECTION 44-29-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO BURYING OR BURNING OF DEAD ANIMALS AND POULTRY, SO AS TO PROHIBIT A PERSON OR BUSINESS THAT TREATS OR CARES FOR ANIMALS FROM DISPOSING OF DEAD ANIMALS IN LANDFILLS OR OTHER GARBAGE OR TRASH COLLECTION METHODS AND TO REQUIRE THAT DEAD ANIMALS BE INCINERATED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 44-29-30 of the 1976 Code is amended to read:

"Section 44-29-30. Whenever any When an animal or poultry shall die dies from any natural or other cause causes, except from being slaughtered or killed for the use of man, or the dead body thereof be carcass is found upon the premises of any a person, be he the owner or tenant thereof, the owner of such the dead animal or poultry, or the owner or tenant of the lands or premises upon which such dead bodies may be the carcass is found, shall immediately shall burn or bury or cause to be burned or buried such the dead animal or poultry. When buried, an animal shall must be put not less than at least three feet and poultry not less than at least one foot under the ground. Any The owner of any such the dead animal or poultry, knowing that such dead animal or poultry is lying dead upon his premises, or any tenant on premises having such who has knowledge or having notice thereof that a dead animal or poultry is lying upon his premises or another's, who refuses or fails to bury or burn such the dead animal or poultry as aforesaid shall be is guilty of a misdemeanor and, upon conviction thereof, shall must be fined in a sum of not less than five dollars or more than one hundred dollars, or be imprisoned for a period of not more than thirty days.

A person or business engaged in the treatment or care of animals, including, but not limited to veterinarians, animal hospitals, and animal shelters are prohibited from disposing of dead animals by sending them to a landfill or disposing of them by other garbage or trash collection method. The person or business must incinerate the carcasses."

SECTION 2. This act takes effect upon approval by the Governor.
