A Bill to amend the Code of Laws of South Carolina, 1976, by adding Section
16-13-131 so as to authorize under certain conditions the detention of a
suspected shoplifter by a merchant or his agents or employees pending further
investigation of the crime and the arrival of the arresting officer and to
provide that statements made by the suspect during such detention shall
constitute admissible evidence; by adding Section 17-13-31 so as to allow
municipal police officers and county sheriffs and deputy sheriffs to arrest
without a warrant those persons detained under Section 16-13-131 and those
other persons the officer has probable cause to believe have committed the
crime of shoplifting; and to amend Section 40-17-130, relating to the
authority of private detective and security guards to make arrests on the
property they are guarding or protecting, so as to grant such persons the
authority to make arrests if they consent thereto and to provide the
procedures to obtain such consent.
