 A Bill to amend Section 55-11-340, Code of Laws of South Carolina, 1976,
 relating to the powers and duties of the Richland-Lexington Airport
 Commission, so as to authorize the Commission to own and provide maintenance
 of postal facilities within the Richland-Lexington Airport District; and to
 amend Act 292 of 1985, relating to the Richland-Lexington Airport Commission,
 so as to provide for the establishment, ownership, operation, and management
 by the District of foreign trade subzones at geographical locations consistent
 with limitations imposed by the Foreign-Trade Zone Act even though these
 locations may be outside the geographical boundaries of the District.

AN ACT TO AMEND SECTION 55-11-340, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE POWERS AND DUTIES OF THE RICHLAND-LEXINGTON AIRPORT COMMISSION, SO AS TO AUTHORIZE THE COMMISSION TO OWN AND PROVIDE MAINTENANCE OF POSTAL FACILITIES WITHIN THE RICHLAND-LEXINGTON AIRPORT DISTRICT; AND TO AMEND ACT 292 OF 1985, RELATING TO THE RICHLAND-LEXINGTON AIRPORT COMMISSION, SO AS TO PROVIDE FOR THE ESTABLISHMENT, OWNERSHIP, OPERATION, AND MANAGEMENT BY THE DISTRICT OF FOREIGN-TRADE SUBZONES AT GEOGRAPHICAL LOCATIONS CONSISTENT WITH LIMITATIONS IMPOSED BY THE FOREIGN TRADE ZONE ACT EVEN THOUGH THESE LOCATIONS MAY BE OUTSIDE THE GEOGRAPHICAL BOUNDARIES OF THE DISTRICT.

Be it enacted by the General Assembly of the State of South Carolina:

Powers and duties

SECTION 1. Item (5) of Section 55-11-340 of the 1976 Code is amended to read:

"(5) To maintain and extend runways, terminals, maintenance shops, access roads, utilities systems, concessions, accommodations, own and maintain within the district postal facilities, and other facilities of whatever nature or kind for the comfort and accommodation of air travelers and air freight; to purchase and sell supplies, goods, and commodities as an incident to the operation of its airport facilities; and for all those purposes, the commission may, by purchase, gift, devise, lease, eminent domain proceedings, or otherwise, acquire, hold, develop, use, lease, mortgage, sell, transfer, and dispose of any property, real or personal, or any interest in it, including easements in or over land needed to prevent airport hazards, or land outside the boundaries of its airports and air navigation facilities necessary to permit the removal, elimination, obstruction-marking or obstruction-lighting of airport hazards, or to prevent the establishment of airport hazards."

Foreign trade subzones authorized

SECTION 2. The first, third, and fourth paragraphs of Section 3 of Act 292 of 1985 are amended to read:

"The Richland-Lexington Airport Commission may make application to the Foreign-Trade Zones Board for the purpose of establishing, operating, and maintaining foreign-trade zones in the district, under the act of Congress known as the Foreign-Trade Zones Act which provides for the establishment, operation, and maintenance of foreign-trade zones in the United States, including the establishment, ownership, operation, and maintenance of subzones outside the district so long as the subzone is established, maintained, and operated in accordance with the provisions of the Foreign-Trade Zone Act and the geographical location of the subzone is within the limitations imposed by the Foreign-Trade Zone Act as administered by the Foreign-Trade Zone Board."

"The commission has the authority to own, erect, maintain, and operate or lease any structures or buildings or enclosures as necessary or proper for establishing, operating, and maintaining these foreign trade zones within the district, and subzones outside the district, but consistent with the provisions of the Foreign-Trade Zone Act."

"The authority granted to the commission confers the right and duty and power to do all things necessary and proper to achieve compliance with the Foreign-Trade Zones Act and to carry into effect the establishing, operating, and maintaining of foreign-trade zones within the district and subzones outside the district but consistent with the provisions of the Foreign-Trade Zone Act."

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
