A HOUSE RESOLUTION

TO MEMORIALIZE THE UNITED STATES CONGRESS TO ENACT NATIONAL "RIGHT-TO-REPAIR" AGRICULTURAL LEGISLATION.

Whereas, farmers should be able to repair their own equipment or choose between multiple equipment repair shops; and

Whereas, giving farmers choices when it comes to repairing their equipment could lead to lower prices for equipment in the long run by stimulating competition; and

Whereas, a national "Right-to-Repair" law would give farmers who are looking for ways to make their hard-earned dollar go further as a means to potentially reduce their equipment repair costs. Now, therefore,

Be it resolved by the House of Representatives:

That the members of the House of Representatives, by this resolution, memorialize the United States Congress to enact national "Right-to-Repair" legislation that provides:

    (1)    a farm equipment manufacturer shall make diagnostic and repair documentation available to an independent repair provider or owner of farm equipment manufactured by the farm equipment manufacturer;

    (2)    subject to item (3), a farm equipment manufacturer that sells farm equipment that contains a security-related function shall make available to an owner or independent repair provider any repair documentation or updates needed to reset the lock or function;

    (3)    if necessary for security purposes, a farm equipment manufacturer may provide information necessary to reset an immobilizer system or security-related electronic module through a secure data release system;

    (4)    any provision in an authorized repair agreement purporting to waive, avoid, or limit a farm equipment manufacturer's compliance with these provisions is void;

    (5)    a violation of these provisions is an unfair, abusive, or deceptive trade practice; and

    (6)    a person convicted of a violation of these provisions must be fined not more than one thousand dollars.

Be it further resolved that a copy of this resolution be presented to each member of the South Carolina Congressional Delegation.
