AN ACT TO AMEND SECTION 59-67-515, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PreviousSPEEDNext LIMIT FOR PUBLIC SCHOOL BUSES AND EXCEPTIONS, SO AS TO, AMONG OTHER THINGS, PROVIDE THAT NO PUBLIC SCHOOL BUS MAY BE OPERATED IN THIS STATE IN EXCESS OF FORTY-FIVE, RATHER THAN THIRTY-FIVE, MILES AN HOUR, EXCEPT WHEN TRAVELING ON A HIGHWAY WITH A POSTED MAXIMUM PreviousSPEEDNext LIMIT ABOVE FIFTY-FIVE MILES AN HOUR OR EXCEPT UNDER CERTAIN OTHER CIRCUMSTANCES, DELETE CERTAIN LANGUAGE, AND PROVIDE THAT PUBLIC SCHOOL BUSES ARE NOT REQUIRED TO HAVE DEVICES TO GOVERN THE PreviousSPEEDNext OR OPERATION OF THE VEHICLES; AND TO REPEAL SECTION 59-67-525, RELATING TO THE PreviousSPEEDNext LIMIT FOR PUBLIC SCHOOL BUSES TRANSPORTING HANDICAPPED CHILDREN.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 59-67-515 of the 1976 Code, as added by Act 351 of 1992, is amended to read:

"Section 59-67-515. No public school bus may be operated in this State in excess of forty-five miles an hour, except when traveling on a highway with a posted maximum PreviousspeedNext limit above fifty-five miles an hour, or when traveling to and from special events which necessitate travel on interstate or state primary highways. Special event variances from the authorized PreviousspeedNext limit for public school buses must be obtained by written authorization from the Department of Education. In no instance may the public school bus be authorized to exceed the PreviousspeedNext of fifty-five miles an hour. Public school buses are not required to have devices to govern the Previousspeed or operation of the vehicles."

Repeal

SECTION 2. Section 59-67-525 of the 1976 Code is repealed.

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
