TO AMEND the south carolina code of laws by amending SECTION 56-5-1560, RELATING TO THE ESTABLISHMENT OF MINIMUM PreviousSPEEDNext LIMITS ALONG THE STATE'S HIGHWAYS, SO AS TO PROVIDE THE MINIMUM PreviousSPEEDNext LIMITs ALONG HIGHWAYs WITH MAXIMUM POSTED PreviousSPEEDNext LIMITs OF SEVENTY MILES AN HOUR IS FIFTY MILES AN HOUR.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1.   Section 56-5-1560 of the S.C. Code is amended to read:

   Section 56-5-1560.   (a)(A) Impeding traffic by slow PreviousspeedNext prohibited. No person shall drive a motor vehicle at such a slow PreviousspeedNext as to impede the normal and reasonable movement of traffic except when reduced PreviousspeedNext is necessary for safe operation or in compliance with law.

   (b)(B) Establishing minimum PreviousspeedNext zones; signs. Whenever the Department of Transportation or local authorities within their respective jurisdictions determine on the basis of an engineering and traffic investigation that slow PreviousspeedsNext on any part of a highway consistently impede the normal and reasonable movement of traffic, the Department of Transportation or local authority may determine and declare a minimum PreviousspeedNext limit below which no person shall drive a vehicle except when necessary for safe operation or in compliance with law, when appropriate signs giving notice thereof are erected along the part of the highway for which a minimum PreviousspeedNext limit is established. Also, any minimum PreviousspeedNext limit adopted by a municipality for a section of the state highway within the municipality shall not be effective until such minimum PreviousspeedNext has been approved by the Department of Transportation.

   (C) The minimum PreviousspeedNext limit along a highway with a maximum posted Previousspeed limit of seventy miles an hour is fifty miles an hour.

SECTION 2.   This act takes effect upon approval by the Governor.
