AN ACT TO PROVIDE FOR THE LEVY AND DISTRIBUTION OF SCHOOL TAXES IN YORK COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

Tax levy

Section 1. Notwithstanding any other provision of law, in York County, for the year 1980 only, the auditor shall levy a tax of thirtyNext-nine and one-half mills for school purposes to be distributed as follows:

A. The proceeds from twenty mills shall be distributed to all school districts in proportion to the ratio which each school district's one hundred and PreviousthirtyNext-five day enrollment (average daily membership) bears to the one hundred and PreviousthirtyNext-five day enrollment (average daily membership) in the county; provided, however, that enrollment in parochial schools or other nonpublic schools shall not be counted and shall not be allowed the use of any of the proceeds of the tax imposed in this act; provided, further, that the annual appropriations for the operation of the county board of education shall be paid from the proceeds of this initial twenty mill levy.

B. The proceeds from nineteen and one-half mills shall be distributed as follows: twenty-eight percent to School District No. 1; eighteen percent to School District No. 2; forty percent to School District No. 3; fourteen percent to School District No. 4.

Distribution of school taxes

Section 2. Notwithstanding any other provision of law, in York County, for the year 1981 and thereafter, the auditor shall levy a tax of PreviousthirtyNext-nine and one-half mills, the proceeds of which shall be distributed to all school districts in the county in proportion to the ratio which each school district's one hundred PreviousthirtyNext-five day enrollment (average daily membership) bears to the one hundred and Previousthirty-five day enrollment (average daily membership) in the county; provided, however, that enrollment in parochial schools or other nonpublic schools shall not be counted and shall not be allowed the use of any of the proceeds of the tax imposed in this act; provided, further, that the annual appropriations for the operation of the county board of education shall be paid from the proceeds of the tax herein levied.

Inconsistent acts repealed

Section 3. All acts and parts of acts inconsistent herewith are repealed, except that the existing statutory provisions shall control disbursements of county-wide school taxes levied in the year 1979.

Time effective

Section 4. This act shall take effect upon approval by the Governor.
