A BILL
TO AMEND SECTION 56-10-270, CODE OF LAWS OF SOUTH
CAROLINA, 1976, RELATING TO PENALTIES FOR OPERATING
AN UNINSURED VEHICLE, SO AS TO PROVIDE THAT UPON
PROOF OF FINANCIAL RESPONSIBILITY, THE PERSON'S
DRIVING PRIVILEGES ARE RESTORED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-10-270(c) of the 1976 Code is amended to
read:
"(c) Any person whose license plates and registration
certificates which are suspended as provided in this section, which are
not suspended for any other reason, may have them immediately
restored, if he files proof of financial responsibility with the department.
The administrative suspension that occurs as a result of a lapse of
automobile insurance coverage does not require proof of financial
responsibility, as required by Section 56-9-500, or thirty day suspension
if there has not been a previous violation for operation of uninsured
vehicle within the past three years or if the person was not driving under
suspension."
SECTION 2. The 1976 Code is amended by adding:
"Section 38-77-370. No automobile insurer doing business in
this State may use the fact that its insured, who was a South Carolina
resident at the time the ticket was issued, paid an out-of-state motor
vehicle speeding ticket, wherein no trial or other adjudicatory
proceeding attended by the insured was held, as evidence of the fault of
its insured, as a basis for imposing a surcharge on the insured's policy
premium."
SECTION 3. This act takes effect upon approval by the Governor.
