House Bill 5021 amends the South Carolina Code of Laws, 1976, by adding Section 20-7-3005 pertaining to child day care facilities conforming with local zoning ordinances.

Section 20-7-3020 (A) of the 1976 Code is amended to grant the Department of Social Services (DSS) the authority to issue provisional approval only when the agency is satisfied that regulations can and will be met within a reasonable PrevioustimeNext, and the deviation does not seriously threaten the health or safety of the children.

The agency does not anticipate a fiscal impact from the enactment of this bill.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-7-3005 SO AS TO PROVIDE THAT UPON LICENSING, APPROVAL, OR REGISTRATION A CHILD DAY CARE FACILITY SHALL PROVIDE PROOF OF CONFORMING WITH LOCAL ZONING ORDINANCES; AND TO AMEND SECTION 20-7-3020, RELATING TO REQUIREMENTS FOR ISSUING A PROVISIONAL LICENSE, REGISTRATION OR APPROVAL, SO AS TO DELETE AN OBSOLETE REFERENCE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 20-7-3005. At the PrevioustimeNext of initial licensing, approval, or registration a child day care facility shall provide proof of conformity or authorized nonconformity with county or municipal zoning ordinances or resolutions. The department may impose conditions on the license, approval, or registration consistent with restrictions imposed by zoning authorities."

SECTION 2. Section 20-7-3020 a. of the 1976 Code is amended to read:

"a. The department shall have has power to issue a provisional registration, provisional license, or provisional approval only when the department is satisfied that (1) the regulations can and will be met within a reasonable Previoustime, and (2) the deviations do not seriously threaten the health or safety of the children. Such A provisional registration, provisional license, or provisional approval, may be extended for such period as may be determined by the department but in no case beyond July 1, 1981."

SECTION 3. This act takes effect upon approval by the Governor.
