AN ACT TO AMEND SECTION 44-93-210, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REGULATION OF THE AMOUNT OF INFECTIOUS WASTE GENERATED IN THE STATE, SO AS TO APPLY CERTAIN LIMITATIONS TO ALL INFECTIOUS WASTE INCINERATOR FACILITIES RATHER THAN ONLY TO COMMERCIAL FACILITIES, AND TO REMOVE THE EXEMPTION FROM THIS LIMITATION FROM HOSPITALS AND GENERATOR FACILITIES; AND TO REPEAL SECTION 44-93-200 RELATING TO HOSPITAL AND GENERATOR FACILITIES' EXEMPTION FROM CERTAIN PROVISIONS OF THE INFECTIOUS WASTE MANAGEMENT ACT.

Be it enacted by the General Assembly of the State of South Carolina:

Monthly limit on amount of waste to be incinerated applies to all facilities

SECTION 1. Section 44-93-210 of the 1976 Code, as added by Part II, Act 612 of 1990, is amended to read:

"Section 44-93-210. (A) Annually the department shall estimate and publish the amount of infectious waste it expects to be generated within this State during the succeeding calendar year. No permitted infectious waste incinerator facility may burn more than one-twelfth of the annual estimate of infectious waste during any one month of the year to which the estimate applies. However, at no PrevioustimeNext may the limit on the amount of infectious waste burned in a month be less than fifteen hundred tons.

(B) For purposes of this section, a permitted infectious waste incinerator facility means a site where infectious waste is incinerated regardless of the number of incinerator units or the ownership of the units."

Repeal

SECTION 2. Section 44-93-200 of the 1976 Code is repealed.
