IS NOT CONFIRMED BY THE SENATE PRIOR TO THE GENERAL ASSEMBLY ADJOURNING, SINE
DIE AND TO PROVIDE THAT IF THE INTERIM APPOINTEE'S NAME IS RESUBMITTED BY THE
GOVERNOR THAT THE APPOINTEE MAY CONTINUE TO SERVE UNTIL FEBRUARY 1, 1998, AT
WHICH TIME THE OFFICE SHALL BE VACANT IF THE APPOINTEE IS NOT CONFIRMED.

A JOINT RESOLUTION
TO PERMIT THE GOVERNOR TO RESUBMIT THE NAME OF
THE INTERIM DIRECTOR SERVING AT THE DEPARTMENT
OF PUBLIC SAFETY IF THE INTERIM APPOINTEE IS NOT
CONFIRMED BY THE SENATE PRIOR TO THE GENERAL
ASSEMBLY ADJOURNING, SINE DIE AND TO PROVIDE THAT
IF THE INTERIM APPOINTEE'S NAME IS RESUBMITTED BY
THE GOVERNOR THAT THE APPOINTEE MAY CONTINUE
TO SERVE UNTIL FEBRUARY 1, 1998, AT WHICH TIME THE
OFFICE SHALL BE VACANT IF THE APPOINTEE IS NOT
CONFIRMED.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. Notwithstanding the provisions of Section 1-3-210,
the Governor may resubmit the name of his acting interim appointee,
as published in the Senate Journal on February 25, 1997, for the
office of Director of the Department of Public Safety if the Senate
fails to confirm the interim appointee prior to the General Assembly
adjourning, sine die. The acting interim appointee may continue to
serve until February 1, 1998, at which time the office shall be vacant
if the appointee is not confirmed and the provisions of Section
1-3-210 shall apply in filling the vacancy, nunc pro tunc.
SECTION 2. This act takes effect upon approval of the Governor.
