AN ACT TO CREATE A STUDY COMMITTEE TO EXAMINE CERTAIN MASS TRANSIT AND HUMAN SERVICES TRANSPORTATION PROGRAMS THROUGHOUT THE STATE, TO PROVIDE THAT IT SHALL ISSUE A REPORT THAT CONTAINS THE STATUS OF THESE PROGRAMS, THEIR LEVEL OF USAGE, FUNDING, AND EFFICIENCIES, TO PROVIDE THAT THE COMMITTEE SHALL STUDY AND MAKE RECOMMENDATIONS ON WAYS TO PROMOTE THE INCREASED USE OF EXISTING MULTIMODAL TRANSPORTATION OPTIONS AND STRATEGIES TO INCREASE ACCESS, MOBILITY, AND SAFETY FOR THE STATE'S CITIZENS, AND TO PROVIDE FOR THE COMMITTEE'S MEMBERSHIP, COMPENSATION, STAFFING, AND DISSOLUTION.

Be it enacted by the General Assembly of the State of South Carolina:

Mass Transit and Human Services Transportation Programs Study Committee

SECTION 1.    (A)(1)    There is created a study committee to examine mass transit and human services transportation programs throughout the State, excluding the state public school bus system. The study committee shall report on the status of the programs, their current levels of usage, funding, the potential availability of additional funds, and efficiencies.

(2)    The study committee shall consider the advisability of expanding mass transit systems throughout the State and the possible creation of a public transportation commission, council, or authority for better coordination of the programs. The study shall include, but is not limited to, the consideration of potential benefits, costs, and efficiencies.

(3)    Additionally, the committee shall study and make recommendations on ways to promote the increased use of existing multimodal transportation options. The study shall include, but is not limited to, strategies to increase access, mobility, and safety for the state's citizens.

(B)    The committee shall be composed of the following members:

(1)    one member appointed by the Governor, who must represent the transportation community;

(2)    one member appointed by the President Pro Tempore of the Senate, who must represent the transportation community;

(3)    one member appointed by the Speaker of the House of Representatives, who must represent the transportation community;

(4)    the chairman of the Senate Transportation Committee, or his designee;

(5)    the chairman of the House of Representatives Education and Public Works Committee, or his designee;

(6)    the secretary of the Department of Transportation, or his designee;

(7)    the president of the Transportation Association of South Carolina, or his designee;

(8)    the executive director of the State Budget and Control Board, or his designee;

(9)    one member representing the Council of Governments;

(10)    the state director of the Department of Social Services, or his designee;

(11)    the state director of the Department of Health and Human Services, or his designee;

(12)    the Secretary of Commerce, or his designee;

(13)    the director of the Lieutenant Governor's Office on Aging, or his designee;

(14)    the state director of the Department of Disabilities and Special Needs, or his designee; and

(15)    the state director of the Vocational Rehabilitation Department, or his designee.

All appointments shall be made by July 31, 2008. The study committee members shall serve without compensation or any per diem. No two appointees may represent the same state agency. Those individuals making appointments shall notify the secretary of the Department of Transportation of their appointments, and the secretary of the Department of Transportation shall call the initial meeting. The secretary of the Department of Transportation, or his designee, shall preside as chairman.

(C)    The Department of Transportation must provide staffing for the committee.

(D)    The committee shall render its report and recommendations to the Governor, the President Pro Tempore of the Senate, the Speaker of the House of Representatives, the chairman of the Senate Transportation Committee, and the chairman of the House Education and Public Works Committee before March 13, 2010, at which time it is dissolved.

Time effective

SECTION    2.    This act takes effect upon approval by the Governor.
