A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE DEPARTMENT OF PUBLIC SAFETY, HIGHWAY PATROL, RELATING TO WINDOW PreviousTINTINGNext, DESIGNATED AS REGULATION DOCUMENT NUMBER 2190, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The regulations of the Department of Public Safety, Highway Patrol, relating to window PrevioustintingNext, designated as Regulation Document Number 2190, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION 2. This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED BY PROMULGATING AGENCY.

State Government Restructuring of 1993, 1976 Code Sections 23-6-20 and 23-6-400, et seq., transferred the Highway Patrol Division from the old Department of Highways and Public Transportation to the Department of Public Safety. Section 23-6-30 of the 1976 Code requires the Department of Public Safety to formulate regulations to administer the duties and responsibilities transferred to it by restructuring. Section 56-5-5015(E) provides that the Department of Public Safety shall prescribe the size and form of the certificate to be used by window PrevioustintNext installers.

To satisfy the requirements of Sections 23-6-30 and 56-5-5015(E), the department is repealing existing window Previoustinting regulations currently found in Regulations 63-411 through 63-416 of the old Department of Highways and Public Transportation regulations and copying the text of 63-412, with a few minor changes, in a section designated for the South Carolina Department of Public Safety. The changes to the language in 63-412 are being made so that the requirements of the regulation will be in compliance with the requirements of Section 56-5-5015 of the 1976 Code. The requirements of Section 56-5-5015 of the 1976 Code are clear and therefore Regulations 63-411 and 63-413 through 63-416 are no longer necessary.
