AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-3-700 SO AS TO PROVIDE A PERSON IS IMMUNE FROM CIVIL LIABILITY FOR PROPERTY DAMAGE RESULTING FROM HIS FORCIBLE ENTRY INTO A MOTOR VEHICLE FOR THE PreviousPURPOSENext OF REMOVING A MINOR OR VULNERABLE ADULT FROM THE VEHICLE IF THE PERSON HAS A REASONABLE GOOD FAITH BELIEF THAT FORCIBLE ENTRY INTO THE VEHICLE IS NECESSARY BECAUSE THE MINOR OR VULNERABLE ADULT IS IN IMMINENT DANGER OF SUFFERING HARM.

Be it enacted by the General Assembly of the State of South Carolina:

Immunity for property damage incurred in rescue from locked vehicle

SECTION    1.    Article 5, Chapter 3, Title 15 of the 1976 Code is amended by adding:

"Section 15-3-700.    A person is immune from civil liability for property damage resulting from his forcible entry into a motor vehicle for the Previouspurpose of removing a minor or vulnerable adult from the vehicle if the person has a reasonable good faith belief that forcible entry into the vehicle is necessary because the minor or vulnerable adult is in imminent danger of suffering harm."

Time effective

SECTION    2.    This act takes effect upon approval by the Governor.

Ratified the 11th day of February, 2016.

Approved the 16th day of February, 2016.
