Let us pray. Creator God, Your creation cries out for Your comfort and guidance. Let these Representatives and staff be the recipients of Your power and strength. Come to each and carry them in the palm of Your hand that what they accomplish here may be to Your honor and glory. Bless our Nation, President, State, Governor, Speaker, this Honorable Assembly, and all who serve in these Halls of Government. Protect our defenders of freedom at home and abroad as they protect us. Hear us as we pray. Amen.

MOTION ADOPTED

Rep. BALLENTINE moved that when the House adjourns, it adjourn in memory of Frances Leonard Agnew of Anderson, mother of Representative Agnew, which was agreed to.

Dear Mr. Speaker and Members of the House:

I am hereby vetoing and returning without my approval H. 4686 (Word version), R. 222. H. 4686 would direct the Budget and Control Board to transfer ownership of a National Guard operations and maintenance shop in Newberry to the County of Newberry.

I am vetoing H. 4686, R. 222, because it allows the State to give away property that has been categorized as surplus. It remains the policy of this administration that the practice of giving surplus property away deprives state taxpayers of both the value of that property and a clear understanding of what government really costs. This has been a long-standing concern of mine.

In 1999, I offered an amendment to the National Defense Authorization Act that would have stopped the Defense Department practice of giving away surplus equipment to local governments. I refused to sign similar bills that came to my desk in 2003, and subsequently announced at a meeting of the Budget and Control Board that I would veto future such conveyances. In 2005 and 2006, I vetoed conveyances of National Guard armories to Inman, Jonesville, Lockhart, Bamberg, and Lake City.

I sincerely believe that if we are to make good decisions in government, they need to reflect the real cost of that decision. The process of giving assets from one level of government to another over-reports the cost of government from the giving entity and under-reports for the receiving government.

Ultimately, there are two fundamental principles at issue here; prudent property management and transparency in government. Both of these principals require, in keeping the best interests of the taxpayers at the forefront, that the State receive fair consideration for the transfer of any surplus state property. Though we believe this transfer is well-intentioned, this bill fails to do that.

Therefore, I am returning H. 4686, R. 222, to you without my signature.

Dear Mr. Speaker and Members of the House:

I am hereby vetoing and returning without my approval H. 3632 (Word version), R. 217, for the same reason I vetoed S. 910, R. 356, in 2006. That veto was sustained and I have taken the liberty of including my reasoning at the time.

This bill mandates that a licensed nurse must clearly be identified by wearing an identification badge at least one inch by three inches in size bearing the nurse's name and title.

Although this bill is well intentioned, I am vetoing H. 3632 because I still believe government should resist the urge to place mandates on private business unless there are compelling reasons to do so.

Government mandates on the private sector have a cost, and I believe only in the event of a compelling societal need should we use the force of government to compel private action. In 2005, I reluctantly allowed a bill to go into law (Lewis Blackman Hospital Safety Act) which mandated ID tags for certain medical personnel in hospitals. I did so because the bill's proponents made a compelling case for patients and their families to be able to immediately identify the various medical personnel who converge on the patient during health emergencies in public hospitals.

In contrast, this bill requires more than 58,000 nurses statewide to wear an ID tag, even though many nurses operate in settings where an emergency situation is unlikely. Other nurses still work almost exclusively in private practices, and many people in these settings have long-standing relationships with their caregivers. In these places, the utility of a nametag is negligible, and government mandates are not appropriate.

I still believe a wiser course is to leave this to the private sector. This type of mandate could be the standard of the South Carolina Medical Association or the South Carolina Nurses' Association to pass professional rules or guidelines for their members. However well intentioned, I do not feel it is Columbia's rightful place to usurp that role.

For these reasons, I am returning H. 3632, R. 217, without my signature.

SECTION   2.   Section 56-5-1538 of the 1976 Code is amended to read:

"Section 56-5-1538.   (A)   An emergency scene is a any location designated by the potential need to provide fire services, emergency medical care, official law enforcement duties, or rescue, recovery and towing operations. and is An emergency scene is identified by emergency vehicles with flashing lights, rescue equipment, or emergency personnel on the scene.

(B)   An emergency scene is a special hazard that requires reduced speed and additional caution by all drivers approaching and entering it.

(C)   An emergency scene is under the authority of the first arriving emergency personnel, which includes emergency medical services personnel, until the arrival of the fire or law enforcement officials having jurisdiction. All motor vehicles passing through an emergency scene and pedestrians observing an emergency scene must obey and not interfere with the duties of emergency personnel. Motor vehicles and bystanders may not block access to or exit from an emergency scene.

(D)   The management authority of emergency medical services is limited to managing patient care and preventing further injury to the patients and on-scene personnel. This authority may be delegated by emergency personnel to provide an adequate level of safety.

(E)   A paid or volunteer worker at an emergency scene has proper authority to be at and control the scene in a manner consistent with his training. This subsection does not relieve this person from the duty to drive while exercising due regard for the safety of all persons using the highway.

(F)   The driver of a vehicle shall ensure that the vehicle is kept under control and shall reduce his speed and be prepared to stop when approaching or passing an emergency scene or authorized emergency vehicle stopped on or near the right-of-way of a street or highway with emergency lights flashing. The exercise of control required for a driver to comply with this section is that control possible and necessary by the driver to prevent a collision, to prevent injury to persons or property, and to avoid interference with the performance of emergency duties by emergency personnel.

(G)   A person driving a vehicle approaching a stationary authorized emergency vehicle that is giving a signal by displaying alternately flashing red, red and white, blue, or red and blue lights, or amber or yellow warning lights shall proceed with due caution, significantly reduce the speed of the vehicle, and:

(1)   yield the right-of-way by making a lane change into a lane not adjacent to that of the authorized emergency vehicle, if possible with due regard to safety and traffic conditions, if on a highway having at least four lanes with not less than two lanes proceeding in the same direction as the approaching vehicle; or

(2)   maintain a safe speed for road conditions, if changing lanes is impossible or unsafe.

(H)(1)   A person who violates the provisions of this section is guilty of the misdemeanor of endangering emergency services personnel improper operation of a motor vehicle when approaching a stationary emergency vehicle and, upon conviction, must be fined not less more than three hundred dollars nor more than five hundred dollars and have four points assessed against his driving record for the first offense.

(2)   For a second or subsequent violation of this section, if the second or subsequent violation occurs within ten years of the previous violation of this section, the person is guilty of a misdemeanor and, upon conviction, must be fined not more than two thousand dollars or imprisoned not more than two years. However, instead of imprisonment, the court may provide for not more than forty-eight hours of public service employment.

(3)   If a person violates this section and causes serious injury or death to a law enforcement officer, firefighter, emergency vehicle operator, or any other emergency response person in the immediate area of the authorized emergency vehicle, he is guilty of a felony and, upon conviction, must be fined not more than ten thousand dollars or imprisoned for not more than ten years.

(I)   For purposes of this section:

(1)   'Authorized emergency vehicle' means any ambulance, police, fire, rescue, recovery, or towing vehicle authorized by this State, county, or municipality to respond to a traffic incident.

(2)   'Emergency services personnel' means fire, police, or emergency medical services personnel (EMS) responding to an emergency incident."

"Article 101
Veteran License Plates

Section 56-3-10040.   (A)   The department may issue a 'Veteran' special motor vehicle license plate for use on a private passenger motor vehicle or motorcycle registered in a person's name in this State who served in the United States Armed Forces, active or reserve components, and who was honorably discharged from service. An application for this special motor vehicle license plate must include official military documentation showing the applicant was honorably discharged from service. Only two plates may be issued to a person.

(B)   The requirements for production and distribution of the plate are those set forth in Section 56-3-8100. The biennial fee for this plate is the regular registration fee set forth in Article 5, Chapter 3 of this title. The Department of Motor Vehicles shall imprint the special license plates with the word 'Veteran', with numbers the department may determine.

(C)   A license plate issued pursuant to this article may be transferred to another vehicle of the same weight class owned by the same person upon application being made and being approved by the Department of Motor Vehicles. It is unlawful for a person to whom the plate has been issued to knowingly permit it to be displayed on any vehicle except the one authorized by the department.

(D)   The provisions of this article do not affect the registration and licensing of motor vehicles as required by other provisions of this chapter but are cumulative to those other provisions. A person violating the provisions of this article or a person who (A) fraudulently gives false or fictitious information in any application for a special license plate, as authorized in this article, (B) conceals a material fact, or (C) otherwise commits fraud in the application or in the use of a special license plate issued is guilty of a misdemeanor and, upon conviction, must be punished by a fine of not more than one hundred dollars or by imprisonment for not more than thirty days, or both."
SECTION   2.   Section 56-3-8000(A) of the 1976 Code, as last amended by Act 398 of 2006, is further amended to read:

"(A)   The Department of Motor Vehicles may issue special motor vehicle license plates to owners of private passenger motor vehicles registered in their names which may have imprinted on the plate the emblem, a seal, or other symbol the department considers appropriate of an organization which has obtained certification pursuant to either Section 501(C)(3), 501(C)(6), 501(C)(7), or 501(C)(8) of the Federal Internal Revenue Code and maintained this certification for a period of five years. The biennial fee for this special license plate is the regular registration fee set forth in Article 5, Chapter 3 of this title plus an additional fee to be requested by the individual or organization seeking issuance of the plate. The initial fee amount requested may be changed only every five years from the first year the plate is issued. Of the additional fee collected pursuant to this section, the Comptroller General shall place sufficient funds into a special restricted account to be used by the Department of Motor Vehicles to defray the expenses of producing and administering special license plates. Any of the remaining fee not placed in the restricted account must be distributed to an organization designated by the individual or organization seeking issuance of the license plate. The special license plate must be issued or revalidated for a biennial period which expires twenty-four months from the month it is issued."

/(6)   'Redevelopment project' means any buildings, improvements, including street, road and highway improvements, water, sewer and storm drainage facilities, parking facilities, tourism and recreation-related facilities, energy production or transmission infrastructure, communications technology, and public transportation infrastructure including, but not limited to, rail and airport facilities. Any project or undertaking authorized under Section 6-21-50 also may also qualify as a redevelopment project under this chapter. All such the projects are to be publicly owned. A redevelopment may be located outside of the redevelopment area provided the municipality makes specific findings of benefit to the redevelopment project area and the project area is located within the municipal limits. A redevelopment project for purposes of this chapter also includes affordable housing projects where all or a part of new property tax revenues generated in the tax increment financing district are used to provide or support publicly-owned affordable housing in the district or is used to provide infrastructure projects to support privately-owned affordable housing in the district. The term 'affordable housing' as used herein means residential housing for rent or sale that is appropriately priced for rent or sale to a person or family whose income does not exceed eighty percent of the median income for the local area, with adjustments for household size, according to the latest figures available from the United States Department of Housing and Urban Development (HUD)./
Amend the bill further, as and if amended, by striking item (7) of Section 31-7-30 of the 1976 Code, as contained in SECTION 2, and inserting:

(b)   A motorcycle owned or leased by and licensed and registered in the name of a legal resident of this State who is a veteran of the armed forces of the United States who is permanently and totally disabled or who has suffered the loss of a limb as a result of a service-connected disability and who files with the Department of Revenue a certificate signed by the county service officer certifying this disability. This exemption applies to the surviving spouse of a qualified disabled veteran for the lifetime or until the remarriage of the surviving spouse."
SECTION   2.   This act takes effect upon approval by the Governor./

Be it enacted by the General Assembly of the State of South Carolina:

SECTION   1.   It is proposed that Section 16, Article X of the Constitution of this State be amended by adding a new paragraph at the end to read:

"Notwithstanding the provisions of Section 11 of this article, the funds of any trust fund established by the General Assembly by law for the funding of post-employment benefits for state employees and public school teachers may be invested and reinvested in equity securities subject to the same limitations on such investments applicable for the funds of the various state-operated retirement systems."

SECTION   2.   The proposed amendment must be submitted to the qualified electors at the next general election for representatives. Ballots must be provided at the various voting precincts with the following words printed or written on the ballot:

"Must Section 16, Article X of the Constitution of this State relating to benefits and funding of public employee pension plans in this State and the investments allowed for funds of the various state-operated retirement systems be amended so as to provide that the funds of any trust fund established by law for the funding of post-employment benefits for state employees and public school teachers may be invested and reinvested in equity securities subject to the same limitations on such investments applicable for the funds of the various state-operated retirement systems?

The court may suspend the imposition or execution of all or part of the sentence, except the thirty-day mandatory minimum sentence, conditioned upon the offender completing, to the satisfaction of the court, and in accordance with the provisions of Section 16-25-20(I), a program designed to treat batterers. If a person is sentenced to a mandatory minimum of thirty days pursuant to the provisions of this section, the judge may provide that the sentence be served two days during the week or on weekends until the sentence is completed and. The offender is eligible for early release based on credits he is able to earn during the service of his sentence, including, but not limited to, good-time credits." /
