Deliberations were opened with prayer by Rev. Jeff Lingerfelt as follows:
Our thought for today is from Psalm 125:1-2: "Those who trust in the Lord are as Mount Zion, which cannot be moved but abides forever. As the mountains surround Jerusalem, so the Lord surrounds his people from this time forth and forever."
Let us pray. O Lord our God and ever blessed Father: You, O Lord are our rock and our redeemer. You are holy and just and will by no means leave the guilty unpunished. You have established Your word and it remains forever. Your word is truth; sanctify us in truth! We are needy creatures, bearing the Adamic curse passed down from our first parents. Yet in Your mercy, You have given us Your Messiah to cleanse us, sanctify us for holiness, and redeem us from the curse that has afflicted all humanity since the fall. May we, your elected officials govern with wisdom and justice this day, seeking the good and flourishing's of this great state. We are needy people, deeply dependent upon Your guidance, wisdom, and grace in all that we do. Help us, so that we may be pleasing to You this day in all our deliberations. To the praise and glory of God the Father. Amen.

Pursuant to S.C. Code Section 44-53-160(C), the Department shall designate a substance as a controlled substance by scheduling it in accordance with an order effecting federal scheduling as a controlled substance.
The U.S. Department of Justice, Drug Enforcement Administration (DEA) issued a temporary order placing 2-(2-fluorophenyl)-2-(methylamino)cyclohexan-1-one (commonly known as 2-fluorodeschloroketamine or 2-FDCK), including all salts, isomers, and salts of isomers into Schedule I of the federal Controlled Substance Act, effective May 22, 2026, until May 22, 2028. F.R., Volume 91, Number 99, pages 30204-30209.
The Department makes this notification in accordance with S.C. Code Section 44-53-160(C), which requires the Department to notify the General Assembly of an addition of a controlled substance in conformity with federal law. Schedule I controlled substances are found in S.C. Code Section 44-53-190.

WHEREAS, pursuant to S.C. Code Section 44-S3-160(C), as amended by 2026 Act No. 146, Section 163, the South Carolina. Department of Public Health shall designate a substance as a controlled substance by scheduling it in accordance with an order affecting federal scheduling as a controlled substance; WHEREAS, the U.S. Department of Justice, Drug Enforcement Administration ("DEA"), issued a temporary order placing 2-(2-fluorophenyl)-2-(methylamino)cyclobexan-l-one (commonly known as 2-fluorodeschloroketamine or 2-FDCK), including all salts, isomers, and salts of isomers into Schedule I of the federal Control1ed Substances Act ("CSA"), in order to avoid an imminent hazard to public safety, effective May 22, 2026, until May 22, 2028. F.R., Volume 91, Number 99, pages 30204-30209;
WHEREAS, the DEA has concluded that 2-tluorodeschloroketamine has high a potential for abuse. no currently accepted medical use in treatment in the United States, and lacks accepted safety data for use under medical supervision; and therefore placed 2-fluorodeschloroketamine in Schedule I of the CSA; and
THEREFORE, the South Carolina Department of Public Health adopts the federal scheduling of 2-(2-fluorophenyl}-2-(methylamino)cyclohexan-1-one (commonly known as 2-fluorodeschloroketamine or 2-FDCK), including its salts. isomers, and salts of isomers, into Schedule I of the South Carolina Controlled Substances Act.

WHEREAS, the U.S. Department of Justice, Drug Enforcement Administration ("DEA"), issued a final rule placing 6,6,9-trimethyl-3-pentyl-6a,7 ,8,9, 10, l Oa-hex.ahydro-6H-benzo[cJchromen-1-ol (also known as hexahydrocannabinol, and HHC) as a separate listing under Schedule I of the federal Controlled Substances Act ("CSA") with its separate drug code, effective May 4, 2026, F.R. Volume 91, Number 85, pp. 23913-23915; WHEREAS, hexahydrocannabinol is already controlled in schedule r of the federal Controlled Substances Act as a tetrahydrocannabinol, which means that the regulatory and criminal sanctions applicable to schedule I contro11ed substance tetrahydrocam1abinol on persons who handle (manufacture, distribute, reverse distribute, import export, engage in research, conduct instructional activities or chemical analysis with, or possess) or propose to handle tetrahydrocannabinol are already applicable to hexahydrocannabinol;
WHEREAS, the DEA has concluded that as hexahydrocannabiuol is currently controlled in schedule I as it meets the definition of tetrahydrocannabino1s, which makes no substantive difference in the 1atus of this drug as a schedule J controlled substance, but instead is a minor, technical amendment with insignificant public interest, the DEA found that publishing a notice of proposed rulemaking and soliciting public comment are unnecessary and that good cause exists to dispense with these procedures;
THEREFORE. the South Carolina Department or Public Health adopts the federal scheduling of 6,6,9-trirnethyl-3-penty)-6a,7,8,9,10,10a-hexahydro-6F/-benzo[c]chromen-1-ol (also known as hexahydrocannabinol, and HHC), ns a separate listing under Schedule I of the South Carolina Controlled Substances Act.
