Deliberations were opened with prayer by Rev. Jeff Lingerfelt as follows:

Our thought for today is from Daniel 4:34-35: "For Your dominion is an everlasting dominion, And Your kingdom endures from generation to generation. All the inhabitants of the earth are accounted as nothing, But He does according to His will in the host of heaven and among the inhabitants of earth. And no one can ward off His hand, or say to Him, 'What have You done?'
Let us pray: O Lord our God, Your Kingdom and dominion is everlasting, enduring forever. There is not one molecule in all of creation that is not under Your omnipotence and omniscience. Your power and knowledge are infinite and beyond all human comprehension. We ask that You would enlighten and empower us to know how we ought to govern those entrusted to our care. As governing authorities, help us with all humility to serve one another to the best of our ability and for Your glory. We pray these things in the name of the Most High God who is ruler over the realm of mankind. Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER .

After corrections to the Journal of the proceedings of yesterday, the SPEAKER ordered it confirmed.

MOTION ADOPTED

Rep. HART moved that when the House adjourns, it adjourn in memory of Reverend Dr. Lillie A Burgess, which was agreed to.

Mr. Speaker, I ask that when we adjourn today, we adjourn in memory of Reverend Dr. Lillie A. Burgess.
Dr. Burgess, passed unexpectedly on Wednesday, January 14, 2026, in Columbia, SC. She enjoyed a distinguished career in academics, received numerous State and National accolades, including the Order of the Palmetto; and she was a prominent speaker and a leader of foreign missions. Her presence and dedicated service will be missed immensely.

Section 8-13-700 that I will not participate in the vote on S.779 which is a Joint Resolution to provide that each member of the General Assembly shall receive a monthly legislative expense allowance of one thousand dollars; to provide for the allocation of legislative expense allowance payments between members whose seats were vacated during fiscal year 2025-2026 and the members elected to fill the vacancy; and to provide that members of the general assembly whose seats were vacated due to the member being convicted of or pleading guilt or nolo contendere to a felony are not entitled to a legislative expense allowance payment pursuant to this act. I will abstain from this vote because of a potential conflict of interest as an economic interest of myself may be affected. Please note this in the House Journal.

(A) An individual employee or student who, while accessing a restroom or changing facility designated for use by their sex, encounters a person of the opposite sex in that restroom or changing facility, has a private cause of action for declaratory and injunctive relief against the public school or public institution of higher learning that:

(1) provided the person permission to use a restroom or changing facility of the opposite sex; or

(2) failed to take reasonable steps to prohibit the person of the opposite sex from using the restroom or changing facility of the opposite sex.

(B) An individual employee or student required by the public school or public institution of higher learning to share sleeping quarters with a person of the opposite sex has a private cause of action for declaratory and injunctive relief against the offending public school or public institution of higher learning.

(C) All civil action brought pursuant to this section must be initiated within two years after the violation occurred. An individual employee or student aggrieved under this section who prevails in court may recover reasonable attorney fees and costs from the offending public school or public institution of higher learning.

Any public school or public institution of higher learning restrooms and changing facilities that are designated for one sex must be used only by members of that sex. Any restroom or changing facility designated for one sex on a temporary or event-based basis, must be used only by members of that sex during the period of such designation. No person may enter a restroom or changing facility that is designated for one sex unless he or she is a member of that sex; and the public school or public institution of higher learning shall take reasonable steps to ensure that all restrooms and changing facilities provide its users with privacy from members of the opposite sex. All restrooms and changing facilities must have a changing table installed equipped to change an infant or toddler. The provisions in this item do not apply:

(1) to custodial or maintenance work when the restroom or changing facility is not being used or otherwise occupied by a member of the opposite sex;

(2) to provide coaching or athletic training during athletic events by coaching staff in changing rooms when no individual is in a state of undress;

(3) to a person or people rendering medical assistance; and

(4) during a natural disaster, emergency, or when use of the restroom or changing facility is necessary to prevent a serious threat to good order or student safety.
