Deliberations were opened with prayer by Rev. Jeff Lingerfelt as follows:

Our thought for today is from Psalm 54:4: "Behold, God is my helper; The Lord is the sustainer of my soul."
Let us pray: O Lord our God and Father You have been our sustainer. You have been our helper, comforter and guardian. We can say, I will not be afraid. What can man do to me? Because the Lord stood by me and strengthened me. From the 430 years in Egyptian bondage, the 40 years of the Exodus wonderings, the 70 years of the Babylonian captivity and each of us, our life span here on earth, you have governed and sustained your children each moment of our being. Thank you for your providential care and provisions. Lord govern our thoughts and actions in wisdom and knowledge as we seek to lead, guide and direct the people of this state. Help us to be light and life to those we represent throughout this state. "Blessed are you, O Lord, the God of Israel our father, forever and ever. Yours, O Lord, is the greatness and the power and the glory and the victory and the majesty, for all that is in the heavens and in the earth is yours. Yours is the kingdom, O Lord, and you are exalted as head above all. Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of yesterday, the SPEAKER ordered it confirmed.

MOTION ADOPTED

Rep. T. MOORE moved that when the House adjourns, it adjourn in memory of James "Jim" Thomas, Jr., which was agreed to.

In Memory of Mr. James "Jim" H. Thomas Jr.

Mr. Speaker, I ask that when we adjourn today, we adjourn in memory of Mr. James "Jim" H. Thomas Jr.
A native of Columbia, SC, Jim graduated from Baptist College of Charleston, now Charleston Southern before beginning a 40-year career in the telephone industry. He served as chairman of Spartanburg Area Chamber of Commerce, Downtown Spartanburg Rotary Club, Palmetto Council Boys Scouts of America, and held leadership positions in United Way, Arts Partnership, and Urban League. One of his most prized memories was the privilege of carrying the Olympic torch in 1996 as it made its way to Atlanta.
Jim led an extraordinary life and will be missed by all of those who were lucky enough to love him.

SECTION 1.   Section 7-7-40 of the S.C. Code is amended by adding a subsection to read:

(D) Notwithstanding the provisions of Section 7-7-920, if the Board of Voter Registration and Elections of Aiken County determines that a precinct contains no suitable location for a polling place, the board, upon approval by a majority of the county legislative delegation, may locate the polling place inside the county and within five miles of the precinct's boundaries.
SECTION 2.   Section 5-15-60 of the S.C. Code is amended to read:

Section 5-15-60.   Each municipality in this State shall adopt by ordinance one of the following alternative methods of nominating candidates for and determining the results of its nonpartisan elections:

(1) The nonpartisan plurality method prescribed in Section 5-15-61;

(2) The nonpartisan election and runoff election method prescribed in Section 5-15-62;

(3) The nonpartisan primary election and general election method prescribed in Section 5-15-63. If nonpartisan elections are not provided for, nomination of candidates for municipal offices may be by party primary, party convention or by petition in accordance with the provisions of this chapter, the applicable provisions of the state election laws and the rules of municipal political party organizations not in conflict therewith. Provided, any municipality which elects to hold partisan elections for municipal offices must pay all costs and expenses associated with the conduct of a municipal primary election.
SECTION 3.   This act takes effect upon approval by the Governor.

SECTION X.   Section 40-43-30(50) of the S.C. Code is amended to read:

(50) "Practice of pharmacy" means the:

(a) interpretation, evaluation, and dispensing of prescription drug orders in the patient's best interest;

(b) participation in drug and device selection, drug administration, prospective drug reviews, and drug or drug-related research;

(c) provision of patient counseling and the provision of those acts or services necessary to provide pharmacy care and drug therapy management;

(d) responsibility for compounding and labeling of drugs and devices, (except labeling by a manufacturer, repackager, or distributor or nonprescription drugs and commercially packaged legend drugs and devices) proper and safe storage of drugs and devices and maintenance of proper records for them;

(e) initiation, ordering, and administration of flu and COVID tests waived under the federal clinical laboratory improvement amendments (CLIA) of 1988 and authorized by the Food and Drug Administration for influenza, SARS-COV-2, streptococcal pharyngitis, and others as approved by the Board of Medical Examiners and Board of Pharmacy. Pharmacists may delegate the task of administering tests provided for in this subsection to a trained pharmacy technician or pharmacy intern, but the pharmacist must perform any interpretation of the results;

(f) initiate treatment of conditions identified in subitem (e) pursuant to identical joint written protocol issued by the Board of Medical Examiners and Board of Pharmacy which must be issued within ninety days of the effective date of this subitem and updated as needed but no less than annually;

(f)(g) reporting of a person's flu or COVID test resultsreporting of tests performed pursuant to subitem (e) and treatment provided pursuant to subitem (f) and the referral of that patient for follow-up care to the health care provider identified by the patient or if none is identified, to an appropriate health care provider as needed; or

(g)(h) the offering or performing of those acts, services, operations, or transactions necessary in the conduct, operation, education, management, and control of pharmacy.

Amend the bill, as and if amended, SECTION 1, by striking Section 44-81-40(P) and (Q) and inserting:

(P) A resident or a resident's legal representative may contract with a person not associated with or employed by the facility to perform sitter services unless the services are prohibited from being performed by a private contractor by state or federal law or by the written contract between the facility and the resident. The person, being a private contractor, is required to abide by and follow the policies and procedures of the facility as they pertain to sitters and volunteers. The person must be selected from an approved list or agency and approved by the facility. All residents or residents' legal representatives employing a private contractor must agree in writing to hold the facility harmless from any liability.

(Q) Each resident or representative of a resident may designate up to three people who are permitted to visit the resident in the event that access to the facility is limited or prohibited due to a declared state of emergency arising from a disaster or public health emergency. Only one visitor per resident shall be allowed at any time during regular visiting hours. The resident or representative of a resident shall provide the facility each person's name, relationship to the resident, and contact information. The designated person must be allowed to regularly visit the resident during the time that access to the facility is limited or prohibited. A resident or representative of a resident may change the list of designated visitors twice during any calendar year or at such time as a designated visitor is permanently unable to continue to visit. Nothing in this subsection may be construed to require a resident, or the resident's representative, to authorize visitation by any particular member of the clergy or any other individual acting in a religious or spiritual capacity if doing so would be inconsistent with that resident's or representative's religious beliefs.

(1) all other appropriate treatment space in the hospital has been exhausted; and

(2) the health and safety of patients is jeopardized without the use of patient beds in these areas.
Amend the bill further, SECTION 1, by striking Section 44-7-255(D)(6) and inserting:

(6) the signature of the emergency department physician on sitea designated member of the emergency department leadership team at the onset of the justified emergency.

(a) a law enforcement agency is controlling traffic during such athletic event; and

(b) the golf cart and the person operating the golf cart are in compliance with subsections (A), (B), and (E).

(2) A golf cart operated at night pursuant to this subsection must operate with working headlights and taillights.

The Committee on Education and Public Works proposed the following Amendment No. 1 to H. 4738 (Word version) (LC-4738.WAB0002H), which was adopted:
Amend the bill, as and if amended, by adding appropriately numbered SECTIONS to read:
SECTION X.   Section 59-143-10(C) of the S.C. Code is amended to read:

(C) Funds made available for Need-based Grants and Palmetto Fellows Scholarships through the Higher Education Scholarship Grants allocation must be no more than the prior year's earned revenue and must be released for use on July first and January first of each fiscal year. Notwithstanding the provisions of this section, any unspent balance in the Higher Education Scholarship Grants allocation of the Children's Education Endowment Fund, including interest and low-level radioactive waste tax revenue from previous years' collections, may be made available for Need-based Grants and Palmetto Fellows Scholarships.
SECTION X.   Section 59-143-30 of the S.C. Code is amended to read:

Section 59-143-30.   (1) Of the funds made available for higher education scholarship grants from the higher education scholarship grant allocation under Section 59-143-10 of the 1976 Code for any year, a percentage thereof must be allocated for higher education scholarships and grants for students attending South Carolina independent colleges of higher learning in this State. This percentage shall be equivalent to the percentage of the independent colleges' share of the total South Carolina resident undergraduate full-time (FTE) enrollment of all public and independent higher education institutions in South Carolina based on the previous year's data as determined by the Commission on Higher Education and the South Carolina Tuition Grants Commission one-half shall be allocated for Need-based Grants and one-half shall be allocated for Palmetto Fellows Scholarships.

(2) Of the total funds made available for higher education scholarship grants from the higher education scholarship grant allocation under Section 59-143-10 for any year, a percentage thereof must be allocated for students attending independent institutions of higher learning in this State. This percentage shall be equivalent to the percentage of the independent colleges' share of the total South Carolina resident undergraduate full time (FTE) enrollment of all public and independent institutions of higher learning in this State based on the previous year's data as determined by the Commission on Higher Education and the South Carolina Tuition Grants Commission. This percentage shall be drawn from the funds allocated under item (1) for Need-based Grants.

(2)(3) The allocation each year to students at the South Carolina independent colleges under item (1) above(2) shall be used to provide tuition grants under Chapter 113 of Title 59 of the 1976 Code, and Palmetto Fellows Scholarships under Section 59-104-20 of the 1976 Code in the manner the General Assembly shall provide in the annual general appropriations act. Of the funds allocated to independent college students, fifty percent shall be awarded for South Carolina Tuition Grants and fifty percent shall be awarded under the Palmetto Fellows Program. The funds allocated for South Carolina Tuition Grants to South Carolina independent colleges students under this subsection shall be included in the annual appropriation to the Commission on Higher Education and transferred annually into the budget of the South Carolina Tuition Grants Commission in the amount prescribed in item (1)(2) above. The funds allocated for Palmetto Fellows Scholarships to South Carolina independent college students under this subsection shall be included in the annual appropriation to the Commission on Higher Education and may only be awarded to eligible students attending South Carolina independent colleges.

(3)(4) Independent colleges for purposes of this subsection means those institutions eligible to participate in the South Carolina Tuition Grants Program as defined by Section 59-113-50.

(4)(5) Public institutions shall receive the remaining allocation each year of the funds made available for higher education scholarship grants under Section 59-143-10. One-half shall be used to provide higher education need-based grants as provided for in this act or otherwise provided for in state law, and one-half shall be used to provide Palmetto Fellows Scholarships under Section 59-104-20 of the 1976 Code in the manner the General Assembly shall provide in the annual general appropriations act.

(5)(6) The maximum amount of funding provided for awards to students attending South Carolina independent colleges from the Children's Education Endowment Fund for South Carolina Tuition Grants and Palmetto Fellows scholarships shall not exceed the percentage funding calculation described under item (1) above(2).
